Terms and Conditions

These terms govern your use of the Niota Android app and this website (together, the “Service”), operated by Niota Fintech Private Limited(“Niota”, “we”, “us”, “our”). By downloading, opening or using the Service you agree to these terms. If you do not agree, do not use the Service.

Please read these terms alongside our Privacy Policy and our Disclaimer, which form part of them.

What Niota is

Niota is a learning tool for people studying the options market. It connects to a broker account that you already have and presents live market data, including the option chain, institutional activity and a market heatmap, in a form designed to be read and understood.

Niota is not a broker, an exchange, a depository participant or an investment adviser, and is not registered with SEBI. We do not hold your money or securities.

Eligibility

You must be at least 18 years old and legally capable of entering into a contract under Indian law. You are responsible for making sure your use of the Service complies with every law and regulation that applies to you.

Your account

You sign in with Google. You are responsible for keeping access to that account secure, and for everything done through your Niota account. Tell us promptly at support@niota.in if you believe it has been used without your permission.

You may close your account at any time. See Delete your account.

Your broker connection

To see live data you connect your own broker account. That connection is between you and your broker, and it is governed by your broker's terms, not ours. You are responsible for complying with them, including any rules about API access and data use.

Your funds, holdings and order book remain entirely with your broker. We may lose access to a broker integration at any time if that broker changes or withdraws its API, and we are not liable for the consequences of that.

Price

The Service is free to download. Any paid feature we introduce will be marked as paid, and we will tell you what it costs before you are asked to pay for anything. Using a paid feature will always be your choice, and the parts of the Service you already use for free will not be taken away without notice.

Acceptable use

You agree not to:

• scrape, harvest, resell or redistribute data obtained through the Service, or use it to build a competing product,
• reverse engineer, decompile or tamper with the app, except where the law expressly allows it,
• interfere with the Service, probe or overload our infrastructure, or bypass any technical limit or authentication,
• use the Service for anything unlawful, or to infringe anyone's rights,
• share your account with anyone else.

Availability and changes

We may change, suspend or discontinue any part of the Service, and we may add or remove features. We may suspend or terminate your access if you breach these terms or if we reasonably suspect misuse. We aim to give notice where it is practical to do so, but the Service is not guaranteed to be available or uninterrupted.

Intellectual property

The Service, including its software, design, text and the Niota name and logo, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use, and nothing more. Market data belongs to its originating exchange or provider.

No warranty

The Service is provided on an “as is” and “as available” basis, with all faults and without warranties of any kind. To the fullest extent permitted by law we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that any data, figure or calculation in the Service is accurate, complete, current or uninterrupted.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading or investment loss, lost profit, lost opportunity, loss of data, or any indirect, incidental, special or consequential loss arising from your use of the Service or your inability to use it. Every trading and investment decision you make is yours alone. Where liability cannot be excluded, it is limited to the amount you have paid us in the twelve months before the claim, which for a free service is nil.

Indemnity

You agree to indemnify us against any claim, loss or cost arising from your breach of these terms, your misuse of the Service, or your breach of any law or of any third party's rights.

Changes to these terms

We may update these terms. When we make a material change we will update the effective date above and, where appropriate, notify you in the app. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the competent courts in India.
